Supreme Court Drafts Regulations for Use of Artificial Intelligence in Courts, 2026
The Supreme Court of India's AI Committee has drafted the Regulations for Use of Artificial Intelligence in Courts, 2026, to govern responsible AI adoption in the judiciary. A core principle is 'human adjudicative primacy' - no final judgment, order or finding of fact may be reached by algorithmic decision-making alone, and AI outputs remain strictly advisory. Governance will be led by a permanent Apex Body at the Supreme Court, with mandatory technical and ethical impact assessments before any AI tool is deployed. Chief Justice of India Surya Kant cautioned that AI may assist but must never decide. The draft was open for public comment until 15 July 2026. The rules bar AI from deciding bail, judgments or findings of fact on its own.
